Stop Land Grabbers Back at Kibagare Wetland

The Coalition for Constitution Implementation (CCI) in conjunction with the Kibagare Wetland Working Group (KWWG) brings to your attention renewed destruction of Kibagare Wetland by the land grabbers who briefly stopped the construction due to huge public outcry by conservationists.

CCI and KWWG have also learned that the land grabber has since moved to the National Environment Tribunal (NET) to stop National Environment Management Authority (NEMA) from interfering with the construction even after NEMA had issued a stop order for the Construction.

To this effect, CCI and KWWG shall be convening a meeting on Thursday the 13 August 2015 with stakeholders in Nairobi to among other things discuss the renewed destruction of the riparian land as this is contrary to 62 (1), (g) that states that public land includes water catchment areas.

CCI shall also be seeking to be enjoined in the case the grabber has taken to NET and shall also be writing to the Director of Public Prosecution (DPP) so that DPP can immediately institute prosecution over the destruction of Kibagare Wetland and that the grabber be made to restore the wetland as the state is obligated under Article 69 (1) to eliminate processes and activities that are likely to endanger the environment, to ensure protection of biological diversity and to ensure utilization of the environment and natural resources for the benefit of the people of Kenya.
